LEASE DEED                

 

THIS LEASE DEED is made at Lahore on this _____ day of __________, 2017

 

BY AND BETWEEN

 

Mr. Kanwar Abdul Karim  S/o  Chaudhray Nayab  R/o 278-E, St No.2, Rifle Range, Koray Stop Walton Road, Lahore Holding NIC No. 35201-4722403-3 (hereinafter referred as the “Lessor”) which expression shall, unless repugnant to or excluded by the context mean and include his legal heirs, executors, administrators and assigns) OF THE ONE PART

 

 

AND

 

Muhammed Faraz Awan S/o  Mazhar Iqbal  R/o E-157/51-F Mohala Madina Coloney, Bank Street, Walton Lahore Cantt,  Holding NIC No. 35201-8297784-3 (hereinafter referred as the "Lessee") which expression shall mean and include its successors-in-interest(assigns) OF THE OTHER PART

 

WHEREAS the above named Lessor on the date of these presents is seized and owner of a  lower portion located at  278-E, ST # 2, Rifle Range, Koray Stop, Walton Road, Lahore Cantt, measuring 3.5 Marla consist of One Bed attached bath, TV lounge, Kitchen and Garage (hereinafter referred as the “Rented premises"

 

AND WHEREAS the Lessor has agreed to give on lease the “Rented Premises” to Lessee and  his successors-in-interest ( Sadia Arshand W/o Mirza Shabaz Arshad Holding CNIC No. 353024204743-8) for a beauty Parlour and Lessee has agreed to take on lease the rented premises for a period of One Year on the following terms and conditions:-

 

 

NOW THIS AGREEMENT WITNESSETH AND IT IS AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS:-

 

  1. GRANT OF LEASE:

 

  1. The lessor hereby agrees to grant to the lessee the rented premises on lease for the period and on rent as hereinafter specified. In part performance of this agreement, the Owner has delivered possession of the Rented Premises to the lessee on 1 Sep, 2017.

 

  1. Whereas the lessee will be entitled to use the Rented Premises and hand over vacant and peaceful possession of the same in good and tenantable condition in normal wear and tear, at the termination or expiry of this lease or of any renewal(s) thereof.

 

  1. RENT & SECURITY

 

  1. The agreed monthly rent shall be Rs. 24,000/- (Twenty Four Thousand Rupees Only) which shall be extendable at the rate of 10 % of the monthly rent after every 1 year. The lessee shall pay an advance rent for 1 (one) month amounting of Rs. 24,000/- (Twenty Four Thousand Rupees Only)

 

  1. The lessee shall in addition thereto pay a sum of Rs. 75,000/- (Five Thousand Rupees Only) as a security of rented premises to the lessor, which will be refundable at the time of completion of this lease agreement or after vacation of the demised premises whichever comes first.

 

  1. The future rents shall be paid in advance before 10th of each month and all such periodic payments of demised property to the lesser shall be made by the lessee.

 

  1. The lease shall be initially for a period of One Year commencing from 1
    September , 2017 and expiring on  1 September March2018.

                                                                 

  1. The period of lease hereunder shall start from 1th September, 2017, the date of possession given by the owner.

 

  1. The lessee shall be deemed as terminated after the expiry of the period of lease as mentioned in this lease deed, and the lessee shall deliver the vacant and peaceful possession of the demised property only to the lessor at the expiry of the lease period.

 

  1.  However the lessee shall be bound to vacant the possession upon the 1(one) month prior notice if the lessor requires the rented premises for their own or for any other purpose.

 

 

  1. OBLIGATIONS ON THE LESSOR:

 

  1. The Lessor hereby assures the Lessee that it has a valid and subsisting title to the Rented Premises and has full power and legal authority to grant a lease to the lessee as herein agreed.

 

  1. The lessor warrants that the rented premises are provided with adequate utility facilities except Sui Gas Connection and in this respect all such provisions have been examined by the lessee.

 

  1. The lessor warrants that at the time of the commencement of this Lease, the rented premises and its electrical installations placed in the rented premises are in tenantable condition and all fixtures and fitting, wiring, connections are in good, safe and working conditions and all such provisions have been examined by the lessee.

 

  1. OBLIGATIONS ON THE LESSEE:

 

  1. In addition to the rent herein reserved, the lessee shall pay the electricity charges based on actual consumption and/or recorded in such utility bills and maintain the demised premises in good condition at all times.

 

  1. The lessee agrees to fully carry out the terms of this lease and to hand over vacant and peaceful possession of the demised premises in good and tenantable condition, normal wear and tear, at the termination/expiry of this lease agreement or of any renewal(s) thereof.

 

  1. The lessee agrees to take care of the rented premises and to repair and make good at its own expenses any damage to the rented premises caused by any fault or neglect of the lessee. But this covenant shall not extend to any damage resulting directly or indirectly from reasonable wear and tear, war, riot, earthquakes, floods and other causes beyond the control of the lessee.

 

  1. The lessee shall not sublet or assign the Rented Premises nor allow any licensee for use of the same or part with the possession of the rented Premises or any portion thereof to a third person. Otherwise lessee shall be responsible for all damages caused by any third person.

 

  1. The lessee shall take all reasonable care to preserve and protect the rented Premises, fitting and fixtures in best of condition. Otherwise shall be responsible for damages.

 

  1. The lessee shall purely use the rented premises for the Beauty Parlour and if the lessee use the premises for any other purposes, the lease agreement shall automatically terminated before the expiry of time and the refundable security will be confiscated.

 

 

IN WITNESS WHEREOF the parties hereto have hereunder signed this Deed at Lahore on this____ day of ____ 2017 in the presence of  witnesses.
