Muslim Family Law Ordinanace (MFLO 1961)

he Muslim Family Laws Ordinance (MFLO) of 1961 was a significant step towards women's empowerment in Pakistan. It was enacted to implement recommendations from the Commission on Marriage and Family Laws. The MFLO was a compromise between modernists and traditionalists, and made substantial changes to Pakistan's family law. (VIII of 1961) An Ordinance to give effect to certain recommendations of the Commission on Marriage and Family Laws WHEREAS it is expedient to give effect to certain recommendations of the Commission on Marriage and Family Laws; NOW, THEREFORE, in pursuance of the Proclamation of the seventh day of October, 1958, and in exercise of all powers enabling him in that behalf, the President is pleased to make and promulgate the following Ordinance:

  • Marriage registration: All marriages under Muslim law must be registered. 
  • Maintenance: The MFLO provides for the maintenance of children and wives after divorce. 
  • Polygamy: A man cannot remarry without permission from the Arbitration Council. 
  • Divorce: A man must apply to the Chairman of the Union Council to divorce his wife, and the divorce is effective 90 days after the notice is presented. 

The MFLO was amended in 2015 to include additional provisions to protect women. These included making marriage registration compulsory and requiring nikah registrars to accurately fill out all columns of the nikahnama.
